Legal policies
The terms that apply when you buy from, sell through, or use the website of forkeeps.
Who you are buying from
forkeeps is a resale business selling secondhand, pre-owned, vintage and consigned goods from Via della Parrocchia, 52, 27055 Rivanazzano Terme PV, Italy. We are an independent shop; we are not an agent, dealer or authorised reseller of any brand whose goods we may resell.
italian based love at first wear
These policies govern your use of this website and any purchase you make through it. By placing an order you accept them. If you do not agree with them, please do not order.
Condition and descriptions
Everything we sell is used and is sold as-is, with all faults, in the condition it is in at the time of sale. Secondhand goods carry wear consistent with their age and history — marks, scratches, fading, odours, repairs, missing parts, or components we have no way to test.
We describe and photograph each item as accurately as we reasonably can, and we photograph the actual item you will receive. Even so:
- Measurements are approximate and taken by hand.
- Colours vary between screens, and photographs are not a colour match.
- Condition grading is our honest opinion, not a certification.
- Unless we say otherwise in writing, nothing is tested for full functionality, safety, completeness or fitness for any particular use, and no manufacturer warranty, service history or original packaging comes with it.
To the fullest extent the law allows, forkeeps makes no warranties of any kind about the goods, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Electrical, mechanical, gas, infant, safety and sporting items are sold as collectible or decorative unless we state in writing that they have been tested — have them inspected by a qualified professional before use.
If a listing is missing something you need to know before buying, ask us first. We would much rather answer a question than process a return.
Prices, availability and errors
Prices are in EUR and do not include shipping or tax unless stated. Sales tax is calculated at checkout where it applies.
Almost every item here is a single, unique piece, and the same inventory may be listed in our shop and on other marketplaces at the same time. An item can therefore sell moments before your order reaches us.
Listings are an invitation to buy, not a binding offer, and no contract of sale exists until we accept and fulfil your order. forkeeps may cancel an order and refund you in full — and this is the whole of our liability in these situations — where:
- the item sold elsewhere first or is otherwise no longer available;
- the price, description, photograph or availability was wrong, however that happened; or
- we reasonably suspect fraud, resale abuse, or a payment we cannot verify.
We are not obliged to honour an obvious pricing error, and a refund of what you paid is your only remedy for one.
Ordering and payment
Add an item to your cart and check out on this site. Payment is by card and is handled by our payment processor — card details go straight to them and never reach us, and we do not store them.
Payment is taken when you order. Placing an order means you confirm you are legally able to enter this contract, that the payment method is yours to use, and that the details you have given us are accurate and complete.
You are responsible for the accuracy of your delivery address, contact email and phone number. We are not liable for a delivery that fails because the information you gave us was wrong or incomplete.
Shipping and delivery
Shipping is calculated at checkout from the item's size, weight and destination, so you see the real cost before you pay. We ship with USPS, UPS, FedEx, Lugg, GoShare, Blue Truck and Moverr.
All handling and transit times are estimates, not guarantees. We usually dispatch within a few business days and email you tracking as soon as your order ships. Once a parcel is with the carrier, its progress is outside our control, and forkeeps is not liable for carrier delays, mis-scans, mis-delivery, lost or damaged parcels, weather, strikes, customs holds or any other event beyond our reasonable control. Delivery dates are not of the essence and a delay is not grounds to cancel a shipped order.
Damage and loss in transit
Inspect your order as soon as it arrives. Tell us about transit damage or a missing parcel within 14 days of delivery — or of the last carrier scan — and keep all packaging and the item until the claim is resolved. We need photographs of the item, the box and the packing material to file a carrier claim, and a claim reported late or without them will usually be refused by the carrier, in which case we cannot compensate you.
Where a parcel is confirmed lost or damaged in transit, our liability is limited to the carrier's declared value for that shipment, and we will refund or replace at our discretion once the carrier resolves the claim.
Marked as delivered but not received
If tracking shows delivery and you do not have the parcel, check with your household and neighbours and contact the carrier directly. We are not responsible for theft after a confirmed delivery, and we are not able to refund an order the carrier records as delivered.
Refused, undeliverable and returned parcels
A parcel refused at the door, unclaimed, or returned to us because the address was wrong or nobody was available may be refunded less our original outbound shipping and any return-carriage cost we incur. We do not refund shipping we have already paid.
Large, fragile and freight items
Furniture and other oversized goods may ship by freight or a local delivery service, may be kerbside-only, and may need someone able to receive and move them. Assembly, installation, removal of old goods and carrying items upstairs are not included unless we agree to them in writing.
International orders, duties and taxes
Where we ship outside our own country, any import duty, tax, brokerage or customs charge is yours to pay, on top of what you paid us, and we cannot tell you in advance what it will be. We do not undervalue shipments or mark them as gifts. A parcel abandoned at customs or refused because of a duty charge is treated as a refused parcel above.
Local pickup
Local pickup is available from Via della Parrocchia, 52, 27055 Rivanazzano Terme PV, Italy. Choose pickup at checkout and we will tell you when your order is ready and what our collection hours are.
Please bring your order confirmation, and photo identification where we ask for it. You are responsible for bringing enough help, vehicle space, straps and blankets to load and transport what you have bought. Our staff may assist as a courtesy but are not obliged to, and we are not liable for damage that happens while an item is being loaded into or carried in your own vehicle, or for injury or property damage arising from your loading or transport.
Paid orders are held for 14 days from the date we tell you they are ready. After 30 days, an uncollected order may be treated as abandoned and resold, and no refund is due — contact us before then if you need longer and we will do our best to accommodate you.
Returns and refunds
Because our stock is used, one-of-a-kind and sold as-is, all sales are final except as set out below. We do not accept returns for change of mind, buyer's remorse, a poor fit, a colour that looked different on your screen, or wear we described.
If an item arrives damaged in transit, or is materially not as described, contact us within 14 days of delivery with your order number and clear photographs. We will then arrange a return and, once we have the item back in the condition it was sent, refund it — or repair, replace or partially refund it, at our option. Contact us and get a return authorisation before sending anything back; unauthorised returns may be refused or returned to you at your cost.
Where we accept a return, the item must come back complete, unused since delivery, and packed as well as it arrived. Return shipping is at our cost when the item was damaged in transit or materially not as described, and at yours in every other case we agree to. Original outbound shipping is not refunded except where we cancel the order ourselves.
Refunds go back to the original payment method and typically appear within 5–10 business days of us processing them. Sold-as-seen, clearance, final-sale, "for parts or repair", custom and personalised items are not returnable at all.
Nothing in this section takes away any statutory right you have as a consumer that cannot be excluded by agreement. Where such a right applies, it applies alongside this policy; where the two conflict, your statutory right prevails, and forkeeps's obligations are limited to that right.
Cancellations and changes
Ask us to cancel or change an order as early as you can and we will help if it has not shipped. Once an order has shipped or been collected we cannot cancel it, and the returns section above applies instead. Address changes after dispatch are the carrier's to make, not ours, and we cannot guarantee them.
We may cancel any order, before or after payment, for the reasons listed under prices and availability, and a full refund is your only remedy.
Consignors, vendors and sellers
If you consign items to us, rent booth or shelf space from us, or otherwise sell through us, your separate written consignment, vendor or booth agreement with forkeeps governs that relationship — including commission and fee rates, pricing authority, markdown schedules, payout timing and method, term length, and what happens to unsold goods at the end of the term. This page does not replace that agreement, and where the two differ, that agreement controls.
Points worth stating plainly:
- You warrant that you own what you give us, free of any lien or claim, that it is authentic and not counterfeit, that it is legal to sell, and that it has not been recalled. You indemnify forkeeps against any claim, loss or cost arising from a breach of this.
- We do not guarantee that any item will sell, or the price it will sell for. Pricing, display, promotion, markdowns and which sales channels we list on are ours to decide unless your agreement says otherwise.
- Goods left with us are not insured by us. Unless your agreement says otherwise, we are not liable for loss, theft, damage, deterioration or shrinkage of consigned or vendor-owned goods on our premises, and you should carry your own insurance.
- Unsold goods must be collected within the window in your agreement. After it passes, and after we have given you the notice that agreement requires, unclaimed goods may be marked down, donated or disposed of, and no payment is due for them.
- Payouts are made against cleared funds. Where a sale is later refunded, charged back or reversed, the related commission and payout may be reversed or offset against your balance.
Consignment and vendor payouts, statements and balances are visible to you in your account with us. If you believe a figure is wrong, tell us within 60 days of the statement it appears on so we can investigate while the records are fresh.
Brands, authenticity and intellectual property
Brand names, model names and logos are used nominatively, to identify and describe secondhand goods we are lawfully reselling. Their use does not imply any affiliation with, sponsorship by, or endorsement from the trademark owner, and all trademarks remain the property of their owners.
Where we describe an item as designer or branded, that reflects our honest assessment based on the item itself and what we were told about it. Unless a listing says an item comes with third-party authentication, none is provided and no guarantee of authenticity is given or implied. If you need certainty, have the item authenticated before you buy.
The text, photographs, layout and design of this site are owned by forkeeps or used with permission. Please do not copy, scrape or republish them without our written consent. If you believe something on this site infringes your rights, contact us with the details and we will investigate and remove infringing material where appropriate.
Privacy
We collect only what running a shop needs.
What we collect
- Order information — your name, email address, delivery and billing address, phone number, and what you bought.
- Payment information — handled entirely by our payment processor. We receive a confirmation and the last four digits of the card; we never see or store the full number.
- Account information — where you create an account with us, the details you enter and your order history.
- Technical information — the usual server and analytics data your browser sends, such as IP address, device and browser type, and the pages you viewed.
Why we use it
To take payment, fulfil and deliver your order, handle returns and support, keep the accounting and tax records the law requires us to keep, prevent fraud, and — where you have asked for it — send you news about the shop. You can unsubscribe from marketing at any time from any marketing email we send.
Who we share it with
Only with the service providers we need to run the shop: our payment processor, our shipping carriers and label providers, our e-commerce and inventory platform, our email provider, and our accountants — each handling your data on our behalf and only for that purpose. We also disclose information where the law, a court, or a tax or law-enforcement authority requires it, and to a buyer of the business if it is ever sold. We do not sell your personal information.
Cookies
This site uses cookies and similar technology to keep your cart and session working and to understand how the site is used. You can block or delete cookies in your browser, though parts of the site may then stop working.
How long we keep it
As long as we need it for the purpose we collected it, and after that for as long as tax, accounting and limitation rules require.
Your choices
Depending on where you live, you may have the right to ask for a copy of the personal information we hold about you, to correct it, to have it deleted, or to object to some uses of it. Contact us and we will respond as the law requires. We will need to verify who you are first, and we may keep what we are legally obliged to keep.
Children
This shop is not directed at children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, contact us and we will delete it.
forkeeps is the controller of the information described here. Our contact details are at the bottom of this page.
Using this website
This site is provided as-is and as-available. We work to keep it accurate and online, but we do not warrant that it will be uninterrupted, error-free, secure, or free of anything harmful, and we may change, suspend or withdraw any part of it at any time without notice.
Please do not misuse the site: no scraping or bulk data extraction, no attempt to access accounts or systems that are not yours, no interference with the site's operation or security, no fraudulent or speculative orders, and no unlawful, abusive or infringing content submitted through any form or review feature. We may refuse service, cancel orders, or close an account where we reasonably believe this has happened.
If you create an account, you are responsible for keeping your password confidential and for everything done under your account. Tell us promptly if you think it has been compromised.
Where this site links to another website, that site is not ours and forkeeps is not responsible for its content, its products or its privacy practices.
Limitation of liability
To the fullest extent permitted by law:
- forkeeps is not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profits, lost revenue, lost data, loss of use, or loss of goodwill, arising out of your use of this site or any item bought through it, even if we were told such loss was possible.
- Our total liability for any claim relating to an order — in contract, tort, negligence, strict liability or otherwise — will not exceed the amount you actually paid us for the item the claim concerns.
- We are not liable for injury, death, or damage to property arising from the use, misuse, repair, modification, installation or resale of a secondhand item after it has left our possession, except where the law does not permit us to exclude that liability.
- Neither of us is liable for a failure to perform caused by an event beyond our reasonable control, including carrier failure, supplier failure, utility or network outage, fire, flood, severe weather, epidemic, civil unrest, strike, or government action.
You agree to indemnify and hold forkeeps harmless against any claim, loss, liability or cost (including reasonable legal fees) arising from your breach of these policies, your misuse of this site, or your use or resale of an item bought from us.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is the case, the exclusions and limitations above apply only to the extent that jurisdiction permits, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
Disputes and governing law
Talk to us first. Most problems are a misunderstanding and we would far rather fix one directly than through a card issuer or a court. Contact us with your order number and what went wrong, and give us a reasonable chance to put it right before escalating. Raising a chargeback without contacting us first, on an order we could have resolved, is a breach of these policies.
These policies, and any dispute arising out of them or out of an order placed with us, are governed by the laws of the State of Lombardia applicable where our business is located, without regard to conflict-of-law rules, and the courts of that place have exclusive jurisdiction — except that either of us may bring a claim in small claims court where it qualifies.
Any claim must be brought within one year of the event giving rise to it, to the extent the law allows a contractual limitation period. If any part of these policies is found unenforceable, the rest continues to apply, and nothing here creates a right for anyone other than you and forkeeps.
Changes to these policies
We may update this page as our business, our carriers or the law change. The version published here at the moment you place an order is the version that governs that order, so please read it each time. Continuing to use the site after a change means you accept the current version.
Contact us
We answer messages ourselves, usually within a couple of business days. For anything about an order, please include your order number.

About ResaleOS
This shop runs on ResaleOS, an e-commerce and inventory platform. ResaleOS is the software behind this website. It is not the seller.
The shop named on this page is an independent business and is solely responsible for:
- the goods offered, their description, condition, authenticity, legality and safety;
- pricing, taxes, availability, order fulfilment, shipping and returns;
- the policies above, and its own compliance with the laws that apply to it;
- the personal information it collects from you and how it handles it.
ResaleOS is not a party to any sale made through this site, is not an agent, broker, consignee or reseller of the shop, does not take title to or possession of any item, and does not inspect, test, authenticate or warrant anything offered here. Payments are taken by the shop through third-party payment processors; the shop is the merchant of record.
To the fullest extent permitted by law, ResaleOS gives no warranty of any kind in respect of the goods, the listings, the policies above or the conduct of this shop, and accepts no liability for them — including for any loss, injury or damage arising from an item bought here, an order that is not delivered as expected, a refund not given, or a dispute with the shop. Any claim of that kind lies against the shop, not against ResaleOS.
Please send anything about an order, a return, a privacy request or a consignment account to the shop, using the contact details above. ResaleOS cannot access, change, refund or cancel a shop's orders on your behalf.
